300Introduction#
This section of the manual will go over all items that affect the department's Internal Affairs and Disciplinary Action. This section will outline all responsibilities and overall supervision within LSPD.
Any complaints within the department will be brought through the division CoC. The division sergeant may choose to handle the issue or escalate it to their lieutenant. If a complaint is deemed "significant" by the division sergeant or lieutenant, it will be immediately classified and forwarded to Command. An IA form must be filled out by the initial Officer if it is deemed significant by the sergeant or lieutenant. Officers may skip the chain of command if the complaint is against a superior.
301Confidentiality#
To ensure that all of the complaints remain confidential the department, LSPD Command has established the following rules:
- All information regarding complaints and IA cases are considered confidential and for that reason, all information is to be kept confidential and may only be shared with applicable staff.
- All documentation regarding complaints shall remain confidential until the case has been closed and a Disciplinary Action Form (DAF) has been submitted.
302Reporting#
During a general patrol, every LSPD member shall report any misconduct to the appropriate on-duty supervisor.
- No LSPD member shall condone any misconduct from any Officer.
- No member shall be obstructed in filing a complaint against any LSPD member.
- No member shall be instructed to not file a complaint.
- No member shall be retaliated for filing a complaint against any LSPD member (this also conforms with other department complaints).
303Complaint Outcome#
LSPD Command would like to streamline the outcome of all complaints for clarification purposes. For this reason, all complaints close with any of the following dispositions:
303-01Unfounded#
The investigation concluded finding no evidence to confirm any form of misconduct, and the case was dismissed.
303-02Exonerated#
The investigation concluded finding all actions to be within the law and or policy.
303-03Not Sustained#
The investigation concluded and the case was dismissed due to lack of evidence.
303-04Sustained#
The investigation found sufficient evidence of misconduct or policy violation(s).
303-05Referral#
The complaint was closed and referred to a different branch or department.
All LSPD IA cases must be reviewed by either the Chief of Police, or Deputy Chief. All disciplinary action at any level must be logged in the appropriate channel within 48 hours of action being taken.
304Disciplinary Action#
All Corporals+ have the ability to hand out disciplinary action to any member of LSPD, regardless of their division. They may not discipline other members of the same rank or superiors.
All types of disciplinary action considered "invasive" or higher must have 2 LSPD CoC members concur on the form of discipline and connecting with LSPD Command is recommended prior to issuing this disciplinary action.
There are several disciplinary actions that can be handed out by Corporals up to Command. All disciplinary action will be outlined below. Any disciplinary action from "Invasive" and above is instantly placed under review after submission by Administration.
| Name | Type | Description | Authority |
|---|---|---|---|
| Verbal Warning | Minimal | A verbal warning is a minor form of disciplinary action. Members are often given a verbal warning when a member commits a violation while on the server. The violation is minor to extensive and must be logged for further referencing. A verbal warning can hinder your progress within the community if multiple verbal warnings were issued within a short span of time. | Corporals+ |
| Retraining | Invasive | A retraining is issued to any member that has committed several violations within the server that could give Staff and Command the idea the member must be retrained to prevent further issues from developing. When LSPD Command or LSPD Staff determine a retraining to be necessary, the member shall be placed on a patrol hold and will be required to attend the next training that suits them. | Lieutenant+ |
| In-game Warning | Invasive | A or in-game warning, can be issued to any member that has committed severe violations within the PSRP server. Any in game warning can be accompanied by a 4-week promotion hold, however, this is only recommended. The promotion holds can also be longer with multiple in game warnings disciplinary actions in the past. This can go up to 2 months. A in game warning may be accompanied by a 30-day hold. This hold will prevent that member from applying to different divisions, and transferring to different departments. | Sergeant+ |
| Suspension/Demotion | Severe | This suspension will prevent the member from any LSPD activities. The 2 points of a ingame warning (Promotion hold and 30-day hold) also apply to the suspension, however, a promotion hold is required with a suspension. A demotion can be given in lieu of a suspension. The duration of the suspension is at the discretion of the supervisor. | Captain+ |
|---|---|---|---|
| Termination/Blacklist | Severe | A termination is a removal from the department. | Commander+ |
Authority - The rank at which the disciplinary action is unlocked and permitted to be given.
305Appeal Process#
The LSPD Command team handles all cases with the utmost professionalism, objectiveness, and finally respect. However, sometimes an Officer that has been subject to disciplinary action finds the punishment to be unjustified.
If a member still finds the punishment to be unjustified, they may appeal the disciplinary action with LSPD Administration or the ES Director of GSPRP.
When a member determines to appeal he or she shall follow the following instructions to properly file the appeal:
- Lay everything out professionally and also explain why you believe the action was wrongful. The best way to do this is to lay this out in a Google document and send the shareable link to a LSPD Administration member or the PSPRP Emergency Director. When Administration or the emergency director completes their review, they will come to one of the following outcomes:
305-01Overturned#
The action was overturned and all actions that were taken shall be reversed. If a promotion was rejected because of disciplinary action he or she should receive that promotion when the action has been overturned.
305-02Partially Overturned#
The action was partially overturned and some parts of the actions that were taken shall be reversed. A part of the actions remains in place, if a promotion was rejected because of disciplinary action he or she shall receive that promotion when the action has been overturned. This can also include lowering a disciplinary action example: A ingame warning with promotion hold has been overturned, however, a verbal warning has been given instead.
305-03Dismissed#
Command or management has determined the right action was taken and all actions will remain in place.
